DMCA Reporting

At TECHEAD we respect others’ intellectual property rights and we have made every effort to secure appropriate clearances for all proprietary intellectual properties that we have made available on our website Techead.com.

TECHEAD will respond to any and all allegations of copyright violations in accordance with the Digital Millennium Copyright Act (DMCA). The DMCA provides a process for a copyright owner to give notification to an online service provider concerning alleged copyright infringement. When a valid DMCA notification is received, the service provider responds under this process by taking down the offending content. Upon taking down content under the DMCA, TECHEAD will take reasonable steps to contact the owner of the removed content so that a counter-notification may be filed. On receiving a valid counter-notification, we generally restore the content in question, unless we receive notice from the notification provider that a legal action has been filed seeking a court order to restrain the alleged infringer from engaging in the infringing activity.

You may use the notification process below to alert us to claims of infringement other than copyright but such notifications are not covered by the DMCA and will be governed by our Terms of Use.

Please note that these notifications and counter-notifications are real-world legal notices provided outside of the TECHEAD environment. TECHEAD may provide copies of such notices to the participants in the dispute or third parties, at our discretion and as required by law the privacy policy for TECHEAD does not protect information provided in these notices.

To File a Notification on Infringing Content

A written notification must be made. This can be done either by fax (804.782.2033) or written letter (regular mail or courier). Emails will not be accepted unless a prior arrangement has been made.

Please include the following in your notice:

  1. Identify in sufficient detail the copyrighted work(s) that you believe has been infringed upon and a statement of ownership of such work(s).
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
  3. Information reasonably sufficient to permit us to contact you, such as an address, telephone number and e-mail address at which you may be contacted.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law.
  5. Include the following statement: “I have good faith belief that the use of the copyrighted materials described above and contained on the service is not authorized by the copyright owner, its agent or by protection of law.”
  6. A statement, under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  7. Your physical or electronic signature (i.e., “/s/ [print name]”);
  8. (Optional) Provide information, if possible, sufficient to permit us to notify the user(s) who posted the content that allegedly contains infringing material. You may also provide screenshots or other materials that are helpful to identify the works in question. (This is for identification only, not to “prove” substantive claims.)

Please note: The DMCA provides that you may be liable for damages (including costs and attorney’s fees) if you falsely claim that materials infringe your copyrights. We recommend contacting an attorney if you are unsure whether your content is protected by copyright laws.

To File a Counter-notification

If your content has been taken down as a result of a notification by a purported copyright owner that such party’s copyright rights are infringed by your content, you may respond by sending us a DMCA counter-notification as follows:

  1. List the work(s) that was removed by the TECHEAD administrators, and the location at which the material appeared before it was removed. Please identify the object in sufficient detail.
  2. Provide your name, address, telephone number, email address (if available).
  3. State that you consent to the jurisdiction of U.S. Federal District Court for the judicial district in which you reside (or Richmond, Virginia if your address is outside of the United States).
  4. State that you will accept service of process from the person who provided notification to us of the alleged infringement or an agent of such person.
  5. State the following: I swear, under penalty of perjury, that I have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.
  6. Your physical or electronic signature (i.e., “/s/ [print name]”).

Copyright and Content Usage FAQ

How do I get permission to use somebody elses work?

You can ask for it. If you know who the copyright owner is, you may contact the owner directly. If you are not certain about the ownership or have other related questions, you may wish to request that the Copyright Office conduct a search of its records or you may search yourself. See the next question for more details.

How can I find out who owns a copyright?

There is no fee if you conduct a search in person at the Copyright Office. Copyright registrations made and documents recorded from 1978 to date are available for searching online. Privacy Policy

Desktop Service Center, Inc. trading as TECHEAD, is aware of the fact that our customers, employees, vendors and business partners’ (“Associates”) want and expect us to place the highest priority on the privacy and confidentiality of their personal information that may contain Financial Information. At TECHEAD, we know that confidentiality is an important part of the reason our Associates do business with our Company. Because of our commitment to providing the highest levels of security and privacy of our Associates’ personal financial information, TECHEAD has adopted the following privacy policy in order to continue in our total commitment to provide quality service to our customers and employees, vendors and business partners.

1. Protection of Information. TECHEAD recognizes its customers, employees, vendors and business partners’ needs and expectations of privacy and confidentiality when dealing with personal financial information. We maintain standards and have policies in place designed to protect their privacy and to restrict unauthorized access to Associates’ information. TECHEAD maintains security standards and procedures to prevent unauthorized access to confidential Associate information. We update and test our technology to improve the protection of our customer information and to assure the integrity of our information. We hire Hacker to test proof our policy.

2. Collection Use and Retention. TECHEAD will collect, use and retain information about Associates that is necessary to allow us to provide superior service and products tailored to customer needs, and to offer opportunities that we think will be of interest to and benefit our Associates. We collect non-public personal information about our associates from the following sources:

  • Information we receive from customers on applications or other forms.
  • Information about transactions with us, or others; and
  • Information we receive from consumer reporting agencies.
  • Information from Background and or Credit checks.
  • Information that is generated electronically when you visit our website or use our online financial services.

We will tell our associates why we are collecting and retaining this information at their request.

3. Maintenance of Accurate Information. TECHEAD has procedures in place to assure that Associates’ financial information is accurate, current and complete. We have procedures in place to respond to associates requests to correct inaccurate information in a timely manner. We will comply with all federal and state laws and regulations regarding accurate information. Associates are encouraged to notify us immediately if they receive information regarding their information with TECHEAD that they believe to be inaccurate.

4. Limitation of Employee Access. TECHEAD will insure that any employee that has access to Associates’ information has a business reason for that access. TECHEAD discusses with all employees the importance of maintaining confidentiality of any and all customer records. The privacy of customer information is stressed in TECHEAD employment agreement and Employee Handbook that is signed by all employees, and employees are notified that should this policy be violated, appropriate disciplinary measures will be taken.

5. Restrictions on Disclosure of Account Information. TECHEAD does not disclose any non-public personal information about our Associates or former employees to anyone, except as permitted by law.

6. Privacy in Business Relationships for Ancillary Products and Services Maintained. TECHEAD is very selective in choosing third parties that assist us in the delivery of products and services to our customers. There will be occasions when we partner with third parties that are unaffiliated with us in order to offer ancillary products and services that may be of benefit to our customers. Such arrangements may require sharing of employees, vendors and business partners’ information collected as described in Section 2 above to companies that perform marketing services on our behalf and with whom we have joint marketing arrangements. When we enter into such a partnership we will require these third parties to adhere to similar privacy principles.

7. Former Customers. Confidential information of persons who are known to no longer be customers of TECHEAD, will be handled on the same basis as if such person were still a Client.
